CANCELLATION BY YOU
For a full refund, you must cancel at least 24 hours in advance of the start time and date of your booking. No refunds will be provided for cancellations made within 24 hours of departure. Cancellation must be made by phone or SMS to 0444-515-212 or email at sales@dearaustralia.com.au.

CANCELLATION BY US
Our trips are guaranteed to depart once they have two fully paid travellers. We may cancel a trip 12 hours in advance of the start time and date if only one traveller has booked for a trip. If we cancel your trip, you can transfer amounts paid to an alternate travel date or receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control (e.g., cyclone or severe weather event), refunds will be provided. We are not responsible for any incidental expenses that you may have incurred as a result of your booking.

AMEND BOOKINGS
If you want to transfer from one trip to another or transfer your booking to a different date, an administration fee of $30 per seat will apply. Any difference in the price of the tours may either be charged or refunded.

VEHICLE
You will travel in an 11-seat Ford Transit Bus (or similar). The vehicle has air conditioning, comfortable cloth seats, and room for bags.

INCLUSIONS
Travel to and from your destination. English commentary. Drinking water provided. WiFi provided.

EXCLUSIONS
Food, drinks, and discretionary purchases.

VARIABLE PRICING
Our trip prices are subject to seasonal pricing, which is standard practice within the travel industry. This means trip prices may change at any time in accordance with demand, market conditions, and availability. It is possible that different passengers on the same trip have been charged different prices. Any reduced price or discounts that may become available after you have paid will not apply. If you cancel your booking to take advantage of a cheaper price, cancellation fees may apply.

FLEXIBILITY
Please appreciate and acknowledge that our trips sometimes require flexibility, and you should allow for alternatives. The itinerary provided for each trip is a representation of the activities anticipated, but it is possible that the route, schedules, itineraries, and amenities may be subject to alteration without prior notice due to circumstances or events.

OPTIONAL ACTIVITIES
Optional activities not included in the trip price do not form part of the trip. You accept that any assistance given by your tour leader or local representative in arranging optional activities does not render us liable for them in any way. The provision of that activity will be between you and the activity provider.

PHOTOS
You consent to our use of your images taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable license to use such images for publicity and promotional purposes.

TOUR AUTHORITY
Our trips are run by a tour leader. The decisions made by the tour leader are final on all matters likely to affect the safety or well-being of any traveler or staff member participating in the trip. If you fail to comply with a decision made by a tour leader or interfere with the well-being of the tour, the tour leader may direct you to leave the trip immediately, with no right of refund. We may also elect not to carry you on any future trips booked. You must at all times comply with the state and federal laws in Australia.

LIMITED LIABILITY
We connect with companies, agencies, and individuals to assist in the running of our trips as an agent for said third parties. We are not responsible for the acts and omissions of these third parties.
To the fullest extent permitted by law:
- Any liability for any loss, death, injury, or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of these Terms and Conditions, is excluded;
- You release Dear Australia, and our officers, employees, agents, and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip; and
- Any condition or warranty which would otherwise be implied by law into these Terms and Conditions (Implied Warranty) is excluded.
To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (1) the provision of a similar trip to an equivalent value; or (2) a refund of the total amount received by us from you in connection with your booking.
Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive, or exemplary damages.

CLAIMS AND COMPLAINTS
If you have a complaint about your trip, please inform the tour group leader or our local representative at the time so that they can attempt to rectify the matter. If satisfaction is not reached through these means, then any further complaint should be put in writing to us within 14 days from the end of the tour.

SEVERABILITY
In the event that any term or condition contained in these Terms and Conditions is unenforceable or void by operation of law, or as being against public policy or for any other reason, then such term or condition shall be deemed to be severed from these Terms and Conditions or amended accordingly only to such an extent necessary to allow all remaining Terms and Conditions to survive and continue as binding.

APPLICABLE LAW
The laws of Queensland, Australia, govern these Terms and Conditions to the fullest extent allowable. Any disputes in connection with a trip or these Terms and Conditions must be initiated in the courts of Queensland, Australia.
